1. Who We Are & Binding Agreement

"Notable Trip", "we", "us", and "our" refer to Silent Shores LLC, a New Jersey limited liability company doing business as Notable Trip (971 US Highway 202N, Ste R, Branchburg, NJ 08876; Phone/WhatsApp: +1 908-215-6540; Email: info@notabletrip.com). "You", "your", "client", and "traveler" refer to the lead booking individual and all members of the traveling party. By submitting an inquiry, paying a planning fee, authorizing a deposit, or accepting a written itinerary confirmation, you represent that you are at least eighteen (18) years of age, possess the legal capacity to enter into this agreement, and have the express authority to bind all members of your travel party to these Terms.

2. Our Agency Role & Supplier Contracts

Notable Trip acts exclusively as an independent travel advisory and booking agent. We do not own, manage, control, operate, or staff any airline, cruise vessel, motorcoach, rental vehicle, hotel, resort, villa, tour operator, or activity provider ("Suppliers"). What we provide is our professional travel curation, supplier vetting, itinerary design, booking execution, and trip support. Every travel component booked for you constitutes a direct contractual relationship between you and the respective Supplier. Each Supplier's specific terms, conditions, carriage contracts, fare rules, baggage allowances, and cancellation policies govern their service and supersede these Terms in the event of any conflict regarding that specific service. We will provide or make available material Supplier terms before payment. Notable Trip is not liable for Supplier acts, errors, omissions, representations, insolvencies, delays, schedule changes, or personal injury/property damage arising in a Supplier's custody.

3. Quotes, Planning Fees & Pricing Accuracy

3.1 Quotations: Quotes are estimates based on live inventory and exchange rates at the time of quotation. Unless otherwise stated in writing, quotes are valid for seven (7) calendar days and do not hold inventory.

3.2 Planning & Design Fees: For custom itineraries, we may charge a professional planning fee. This fee is disclosed upfront and is non-refundable once design work commences, as it covers professional research and itinerary architecture. It is separate from the cost of the travel itself.

3.3 Pricing Errors: In the event of an obvious typographical, clerical, technological, or supplier pricing error, Notable Trip reserves the right to correct the error. We will notify you promptly and provide the option to confirm the booking at the corrected rate or cancel the affected service with a full refund of payments received for that service, with zero administrative penalty.

4. Confirmation, Inclusions & Price Guarantees

4.1 Confirmation: A booking is finalized only upon receipt of the required deposit in cleared funds and the transmission of our official written booking confirmation. Automated payment receipts do not constitute a confirmation.

4.2 48-Hour Review Duty: You must review your booking confirmation immediately upon receipt. Traveler names must match valid passports character-for-character. You must notify us within forty-eight (48) hours of receipt of any discrepancy. Corrections requested after 48 hours may incur Supplier reissue fees, fare increases, or ticket repurchase costs at your expense.

4.3 Inclusions & Price Hold: Prices are quoted in U.S. Dollars (USD) based on double occupancy unless otherwise specified. Your confirmation details all included services. Excluded items include meals/beverages not listed, passport/visa fees, local tourist/city taxes collected at hotel check-in, optional excursions, baggage fees, resort fees, gratuities, and travel insurance. Once confirmed and paid on schedule, Notable Trip guarantees your price will not increase, except that new or increased government taxes, port fees, or airline fuel surcharges imposed after confirmation may be passed on at direct cost with documentation.

5. Payments, Billing & Payment Authority

5.1 Deposits & Final Payment: Required deposits vary by itinerary and Supplier rules, ranging up to 100% for published airfares, promotional hotel rates, private villas, and chartered services. Final payment due dates are specified on your confirmation (typically 60 days prior to departure; earlier for cruises, holiday peaks, and luxury rail). If cleared funds are not received by the due date, Suppliers reserve the right to cancel reservations and apply cancellation penalties.

5.2 Charging Parties & Foreign Exchange: We accept major credit cards (Visa, MasterCard, American Express) and electronic bank transfers. You authorize Notable Trip and its booked Suppliers to charge your provided payment method for the agreed amounts. Multi-supplier itineraries may reflect separate transactions on your statement (e.g., airline ticket charged by the carrier, hotel deposit charged by the resort). For international suppliers charging in local currency, your financial institution may assess foreign transaction fees or currency conversion spreads, which are external to Notable Trip.

5.3 Chargebacks & Payment Disputes: Nothing in these Terms limits your statutory right to dispute unauthorized or fraudulent transactions. However, you agree not to file a payment dispute or chargeback for legitimate Supplier cancellation penalties or services properly booked and delivered in accordance with these Terms. If a charge is reversed while valid balances remain unpaid, Notable Trip reserves the right to suspend arrangements and provide all booking and payment records to your issuing bank.

6. Rescheduling, Cancellation & Refund Policies

6.1 Written Notice: All change, reschedule, and cancellation requests must be submitted in writing by the lead traveler to info@notabletrip.com. The effective timestamp is the date and time on which Notable Trip receives the written request.

6.2 Reschedule Policy: Notable Trip permits you to reschedule your booked package to a different travel date, subject strictly to the rescheduling, rebooking, and fare/rate difference policies of the individual Suppliers (airlines, hotels, local operators, cruise lines) included in your itinerary. Notable Trip will facilitate the date-change process on your behalf; any Supplier change fees, non-transferable component losses, or seasonal price differences will be passed through to you at cost.

6.3 Staged Cancellation & Refund Policy: Cancellations requested by the client are governed by the following tiered schedule:

• Tier 1 — Within 24 Hours of Booking: Free cancellation of booking with a 100% Money-Back Guarantee, provided the initial deposit/payment was completed and departure is not within 7 days. All recoverable funds will be refunded in full without any Notable Trip administrative fee.
• Tier 2 — After 24 Hours of Booking up to 7 Days Prior to Departure: Cancellations incur a Notable Trip cancellation fee of 10% of the Total Booking Value, in addition to all applicable cancellation and refund policies and penalties imposed by the booked Suppliers, if any. Any balance remaining after deducting the 10% agency fee and applicable Supplier cancellation charges will be refunded to you.
• Tier 3 — Within 7 Days Prior to Departure Date: Strictly Non-Refundable (0% Refund). Cancellations made inside 7 days of scheduled departure forfeit 100% of the total booking value, as all supplier allocations, private transfers, rooms, and tickets are fully locked and unrecoverable.

6.4 Supplier Refund Pass-Through: Notable Trip does not profit from your cancellation beyond our disclosed 10% fee in Tier 2. Where third-party Suppliers issue refunds, we remit all recovered funds directly to you as soon as cleared. Non-air supplier refunds generally take 30 to 90 days depending on international vendor settlement cycles.

6.5 No-Shows & Unused Services: If you fail to check in for a flight, transfer, hotel, tour, or scheduled excursion, you will be recorded as a no-show. No refunds, credits, or date shifts will be provided for no-shows or unused portions of any travel package.

7. Operational Changes & U.S. DOT Airfare Refunds

7.1 Supplier Schedule Modifications: Airlines and operators may adjust schedules, routes, or equipment. For non-air services, minor operational adjustments of comparable standard do not warrant compensation. In the event of a significant change (e.g., hotel closure, itinerary overhaul), Notable Trip will act as your advocate to secure comparable alternatives or supplier credits/refunds.

7.2 U.S. DOT Airfare Refund Compliance: For air transportation departing from, arriving in, or transiting within the United States, nothing in these Terms impairs your rights under U.S. Department of Transportation regulations (including 14 CFR Parts 259/260 and DOT Final Rules). If an airline cancels a flight or makes a significant schedule change (such as a departure/arrival adjustment of 3+ hours domestic or 6+ hours international, significant airport change, or downgrade in class of service) and you decline alternative transportation or travel credits, you are entitled to a full cash refund of the unutilized airfare. Where Notable Trip acts as the merchant of record for the ticket transaction, we will process your statutory airfare refund within seven (7) business days for credit card payments or twenty (20) days for cash/check/transfer after receiving the required carrier authorization.

8. Flights, Separate Tickets & Baggage

8.1 Airfare Rules: Most discounted, economy, and promotional airline fares are 100% non-refundable and non-changeable once ticketed. Seat selections, upgrades, and meal requests are requests submitted to the carrier and cannot be guaranteed by Notable Trip.

8.2 Check-In & Flight Status: Travelers must reconfirm flight statuses directly with the operating airline 24 to 72 hours prior to departure and arrive at the airport at least 3 hours prior to international flights (2 hours for domestic flights). Missing any single flight leg will result in the airline automatically canceling all subsequent return and connecting legs without refund.

8.3 Separate Tickets & Self-Connections: If your custom itinerary incorporates separate airline tickets on different booking references (PNRs), each carrier operates under a standalone contract. If a delay or cancellation on one carrier causes you to miss a connection on a separate ticket, the connecting carrier is under no legal obligation to rebook or compensate you. Notable Trip is not liable for misconnection costs arising from separate ticket structures.

9. Passports, Visas, Health & Entry Compliance

International travel requires strict compliance with border authorities. It is your sole responsibility to ensure that all members of your party possess:

• (a) A valid machine-readable passport with at least six (6) months validity beyond your scheduled return date and at least two to four blank visa pages;
• (b) All necessary visas, electronic travel authorizations (e.g., ESTA, ETA, e-visas), transit visas, and entry permits required for each destination and transit hub;
• (c) Required health documentation, mandatory vaccinations, and medical declarations; and
• (d) Notarized parental consent letters and unabridged birth certificates for minors traveling with a single parent or guardian where required by national law.

Notable Trip provides general destination guidance as a courtesy, but official entry requirements must be independently verified with the relevant embassy, consulate, or State Department. Notable Trip accepts zero liability for boarding denials, entry refusals, deportations, quarantine costs, or fines resulting from improper documentation, and no refunds are provided under such circumstances.

10. Mandatory Insurance Advisory & Declination

Notable Trip strongly recommends that every traveler purchase comprehensive travel insurance at the time of initial deposit. Comprehensive coverage should include trip cancellation, trip interruption, emergency medical treatment, medical evacuation/repatriation, luggage loss/delay, and adventure activity waivers. Pre-existing medical condition waivers and "Cancel For Any Reason" (CFAR) protections generally must be purchased within 10 to 21 days of initial deposit.

Notable Trip is an agency, not a licensed insurance underwriter. If you decline to purchase comprehensive travel insurance, you acknowledge and accept full individual financial liability for any and all cancellation penalties, medical expenses, evacuation costs, and travel disruptions that would have been compensable under a policy.

11. Assumption of Risk & Inherent Hazards

You acknowledge that international travel, particularly custom adventures, active touring, wildlife excursions, marine charters, and travel to developing regions, involves inherent hazards that cannot be eliminated. These risks include, without limitation: personal injury, illness, exposure to infectious diseases, foodborne illness, accidents on land/water/air transport, extreme weather, altitude sickness, animal encounters, civil unrest, political instability, remote locations with limited medical infrastructure, and criminal acts. By confirming your booking, you voluntarily assume all inherent risks associated with your travel on behalf of yourself and all traveling companions, agreeing that Notable Trip is not liable for injuries or damages arising from risks inherent to the travel environment.

12. Accessibility, Medical Fitness & Conduct

12.1 Accessibility & ADA: Travelers must notify Notable Trip at the initial inquiry stage of any physical, mobility, cognitive, or dietary requirements so we can curate suitable arrangements. You acknowledge that the Americans with Disabilities Act (ADA) applies only within the United States. Overseas infrastructure, historic properties, small safari vehicles, and remote vessels may have architectural barriers or lack accessibility features.

12.2 Medical Fitness: You represent that you and your travel companions are medically and physically fit to undertake the chosen itinerary. Notable Trip and its Suppliers reserve the right to decline or remove any participant whose physical or mental condition endangers themselves or others.

12.3 Traveler Conduct: Suppliers reserve the right to remove any passenger exhibiting disruptive, abusive, intoxicated, or illegal behavior. If a traveler is removed, the travel arrangement terminates immediately without refund, and all repatriation or accommodation expenses are the traveler's sole responsibility. You are liable for any physical damage caused to Supplier property.

13. Client Indemnification

You agree to defend, indemnify, and hold harmless Silent Shores LLC (d/b/a Notable Trip), its officers, directors, employees, and agents from and against any third-party claims, liabilities, losses, damages, fines, penalties, and legal costs (including reasonable attorney fees) arising out of or related to: (a) any breach of these Terms by you or your travel party; (b) inaccurate, fraudulent, or incomplete information provided by you; (c) your violation of any domestic or foreign law; or (d) intentional misconduct, negligence, or property damage committed by you or your travel party during travel. This indemnity does not apply to damages directly caused by Notable Trip's own gross negligence or willful misconduct.

14. Force Majeure & Repatriation Allocation

Notable Trip and its Suppliers are not liable for failure to perform or delays resulting from events beyond reasonable control ("Force Majeure"), including acts of God, extreme weather, hurricanes, wildfires, volcanic eruptions, earthquakes, pandemics, epidemics, government quarantine orders, border closures, airspace shutdowns, war, terrorism, civil commotion, strikes, utility failures, or supplier insolvencies. In the event of a Force Majeure cancellation or interruption, Notable Trip will advocate diligently to secure supplier credits, waivers, or recoverable refunds on your behalf. Any additional costs incurred for emergency accommodation, rerouted transport, or early repatriation remain the sole financial responsibility of the traveler (and are typically insurable).

15. Limitation of Liability & International Treaties

To the maximum extent permitted by applicable law, Notable Trip's total cumulative liability for any claim arising out of its advisory or booking services, whether in contract, tort (including negligence), or otherwise, shall be strictly limited to the total advisory, planning, and service fees actually paid by you to Notable Trip for that specific booking, plus any sums successfully recovered from Suppliers on your behalf. In no event shall Notable Trip be liable for indirect, incidental, special, consequential, or punitive damages (including lost wages, missed opportunities, or loss of enjoyment). Nothing herein limits liability for gross negligence, willful misconduct, or matters that cannot be lawfully disclaimed. Claims involving international carriage by air or sea are subject to the liability limitations set forth in the Montreal Convention, Warsaw Convention, or Athens Convention.

16. Issue Resolution & Contractual Claims Deadline

16.1 In-Trip Reporting Duty: If an issue arises during travel, you must notify the local supplier immediately (hotel front desk, tour director) and contact Notable Trip (+1 908-215-6540; info@notabletrip.com) to allow an opportunity for real-time remediation. Failure to report issues immediately severely limits our ability to rectify problems and may compromise future claims.

16.2 Contractual Limitation Period: Any formal post-trip complaint must be submitted in writing within thirty (30) days of your return. If you believe Notable Trip is legally liable for any loss or dispute, you must deliver formal written notice with supporting evidence within one hundred and eighty (180) days of the incident. Any legal action or formal proceeding against Notable Trip must be initiated within one (1) year of the incident, after which all claims shall be permanently barred.

17. Governing Law, Venue & Commercial Disclosures

17.1 Governing Law & Jurisdiction: These Terms and any dispute arising hereunder are governed exclusively by the laws of the State of New Jersey, without giving effect to conflict of laws principles. The state and federal courts situated in Somerset County / Newark, New Jersey shall have exclusive jurisdiction over all claims.

17.2 Remuneration Disclosure: In addition to disclosed client planning fees, Notable Trip may receive standard commissions, overrides, or incentives from travel suppliers for reservations made on your behalf.

17.3 Seller of Travel & Client Funds: Silent Shores LLC is a registered New Jersey limited liability company. California, Florida, Washington, and Iowa regulate travel sales; registrations and trust accounting operate in compliance with applicable commercial travel standards.

17.4 Severability & Survival: If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions shall continue in full force. Sections 2, 9, 11, 13, 15, 16, and 17 shall survive the termination or completion of your travel.
